DISCIPLINARY DISMISSAL AT NOTICE: sanction to be commensurate to the notified infraction.

We inform that the Court of Cassation, with judgement nr 12806 of the June 6th 2014, on the subject of dismissal resulting from a disciplinary infraction, established that the evaluation of the worker behavior contrasting the incumbent duties must take into account also the "environmental negative impact" that the infraction assume when, in virtue of the professional role in the company, it can become a discouraging example having a negative influence on the other workers: in the specific case the dismissal sanction has been considered proportioned to the event seriousness, also in the presence of only one disobedience episode, taking into account the the role in the company, the remarkable lenght of service, the fact that he was involved in union activity, and the awareness of the caused damage.
